Bankruptcy lawyers use chapter13
A person finds himself in a maze of debt before he realizes it. He tries to come out of it by borrowing from X and repaying Y's debt and then borrows from Y to repay another X's debt. This goes, on and on and one fine day everything collapses. One link in the chain of borrowing and repaying breaks and everything falls into fragments. He becomes a known debtor to his family and friends. He approaches a Bankruptcy lawyer for help and guidance.
The bankruptcy Lawyer studies the situation. The debtor is still holding a fairly good job which is the silver lining. There is no need for liquidation in this case. Chapter 13 of the bankruptcy law is applied by the bankruptcy lawyer. This law of chapter 13 is known as Reorganization. The debtor’s debts are reorganized into a set plan of repayment. An agreement is reached with the creditor and the debtor present. Some amounts of money towards interest is written off. The remaining amount is divided into convenient installments and paid accordingly.
The monthly installments are paid to a Bankruptcy Trustee for a period of three to five years, who in turn disburses those funds to the creditors. The repayment is made methodically through a representative of the law. There will be no room for any more complaints from the creditors. Chapter 13 enables the debtor to release himself from debt without any kind of liquidation of his assets. This is good news for him. Further, his self esteem is saved because he gets the satisfaction that something is paid towards the debt.
